These Terms of Service ("Terms") form a binding legal agreement between you and Guardians Lighthouse, LLC ("Guardians Lighthouse," "we," "us," or "our") and govern your access to and use of our website, content, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Directory Service Only — No Medical Advice
Guardians Lighthouse operates a community-powered directory and informational platform. We are not a healthcare provider, medical practice, insurance company, referral service, or licensed professional. Nothing on the Platform — including provider listings, reviews, ratings, articles, or communications — constitutes medical, psychological, legal, financial, or professional advice, diagnosis, or treatment.
The Platform is intended as a starting point for your own research. You must always consult a qualified, licensed professional regarding any medical or health-related questions or decisions concerning you or your family.
2. Independent Verification of Providers
Listings on the Platform are submitted by providers themselves or compiled from third-party sources. You are solely responsible for independently verifying any provider's credentials, licensing, certifications, malpractice history, insurance coverage, scope of practice, qualifications, and current availability before engaging them. We do not background-check providers and make no representation that any listing is accurate, current, or complete.
3. No Endorsement or Guarantee
We do not endorse, recommend, certify, sponsor, guarantee, or assume any responsibility for any provider, listing, review, or third-party content on the Platform. Inclusion in our directory is not an endorsement of quality, safety, or fitness for any particular purpose. The order in which listings appear is not a ranking, rating, score, or measure of quality.
4. Assumption of Risk
You assume all risks arising from your use of the Platform and any interaction with, communication with, engagement of, or treatment by any provider you find through the Platform. Any decision to contact, hire, visit, retain, pay, or rely on a provider is made at your own risk. Guardians Lighthouse is not a party to any agreement, appointment, or course of care between you and a provider.
5. User Content and Reviews
Reviews and ratings reflect the personal opinions and experiences of individual users. They are not verified by us, are not medical advice, and may not reflect your own experience. By submitting content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, display, distribute, modify, and publish that content on or in connection with the Platform. You represent that your content is truthful, your own, and does not violate any third party's rights or applicable law.
6. Accounts and Fees
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Guardians Lighthouse does not currently charge families or providers to use the Platform: there are no paid memberships, no paid provider tiers, and no recurring subscriptions, and we do not collect payment card information. If we introduce a paid feature in the future, we will describe its price and terms and obtain your agreement before any charge is made.
7. Prohibited Conduct
- Posting false, defamatory, harassing, threatening, or unlawful content.
- Impersonating any person or provider, or misrepresenting your affiliation.
- Scraping, reselling, or republishing directory data without written permission.
- Using the Platform to solicit, market, or transmit unsolicited communications.
- Attempting to interfere with, disrupt, or gain unauthorized access to the Platform.
8. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT ANY PROVIDER, LISTING, OR REVIEW IS ACCURATE, CURRENT, COMPLETE, OR SAFE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUARDIANS LIGHTHOUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORM OR ANY PROVIDER FOUND THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS, IF ANY, YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Guardians Lighthouse and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your interaction with, retention of, or treatment by any provider; (c) any content you submit; (d) your violation of these Terms; or (e) your violation of any law or the rights of any third party.
11. Mandatory Binding Arbitration; Class-Action Waiver
Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform ("Dispute") will be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in the State of Kansas, or by video conference. Judgment on the award may be entered in any court of competent jurisdiction.
You and Guardians Lighthouse each waive any right to a jury trial and any right to participate in a class, collective, or representative action. Disputes must be brought in your individual capacity only. If this class-waiver provision is found unenforceable, the entire arbitration section will be null and void as to that Dispute, but the remainder of these Terms will remain in effect.
Notwithstanding the above, either party may bring an individual claim in small-claims court for Disputes within that court's jurisdiction, and either party may seek injunctive or equitable relief in court to protect intellectual-property rights.
12. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws principles. Subject to Section 11, the exclusive venue for any permitted court action is the state and federal courts located in the State of Kansas.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and arbitration) will survive.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
